Terms of Use for the KeepSheets app
1. Provider and scope
The provider of the KeepSheets app is Constantin Falk, ConstantIT, Miersdorfer Chaussee 8, 15738 Zeuthen, Germany, email info@constantit.de (see the legal notice, German). These terms apply to your use of the app. The Google Play terms of service apply in addition. Mandatory consumer rights remain unaffected.
2. Service
KeepSheets scans, straightens and cleans up documents, recognizes text on the device and creates PDF and JPEG files that you can save or share. All data is processed on your device (see the Privacy Policy). We keep developing the app and may change, add or remove features where reasonable for you.
3. Free use and Pro
The app can be used free of charge. The number of scans per day may be limited. The paid “Pro” upgrade (in-app purchase) removes that limit. The price is shown to you in Google Play before you buy and includes statutory VAT. How Google Play processes the purchase, and how payment, withdrawal and refunds are handled there, is set out in the Google Play terms. Your statutory right of withdrawal remains unaffected; for digital content it may expire by law once performance has started with your express consent. A Pro purchase is tied to your Google account and can be restored on other devices using the same account. The app counts free scans locally; the count resets when you clear the app's data.
4. License
You receive a non-exclusive, non-transferable right to use the app on your own devices for private and business purposes. You may not copy or redistribute the app, circumvent protection mechanisms, or use it in a way that infringes third-party rights or laws. Mandatory statutory rights, for example under sections 69d and 69e of the German Copyright Act, remain unaffected. The app's open-source components are under their own licenses; you can find them in the app under Settings → About → Open-source licenses.
5. Your content and responsibility
You are responsible for the documents you scan, save and share. Please respect copyright, personality and privacy rights of third parties (for example when scanning other people's documents). You keep all rights to your documents; we do not receive a copy.
6. Results without warranty, backups
Edge detection, perspective correction, filters and text recognition work automatically and can make mistakes, for example with handwriting, poor lighting or unusual formats. Check scans before relying on them for important purposes. The app is not a legally reviewed archive. Your data is only on your device and is not backed up automatically; please back up important documents yourself, for example with “Save as …”.
7. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee. For slight negligence we are liable only for breach of an essential contractual obligation (one you may rely on being fulfilled), and then limited to the typical, foreseeable damage. We are liable for data loss only to the extent it would have occurred had you made regular backups appropriate to the value of the data. Otherwise liability is excluded.
8. Changes to these terms
We may change these terms when the app or the law changes. For existing purchases, we will not change essential features to your disadvantage without informing you. The version published here applies.
9. Governing law and dispute resolution
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. As a consumer you keep the protection of the mandatory provisions of the country where you habitually reside. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. The EU Commission's online dispute resolution platform is available at https://ec.europa.eu/consumers/odr/.
